DECLARATION OF CONSENT FOR THE PROCESSING OF PERSONAL DATA

NOTE OF INFORMAION

Pursuant to Article 5 of the Law no. 677/2001 on the Protection of individuals with regard to the processing of personal data and the free movement of such data adopted on 15th of October 2001 (Published in the Official Journal of Romania, Part I, No. 790/12 December 2001), as subsequently amended and completed I, the undersigned,  hereby express my consent to the processing of my personal data by S.C. PricewaterhouseCoopers Tax Advisors and Accountants S.R.L., Romanian legal entity with the registered address in Bucharest Town, 301-311 Barbu Vacarescu St., Lakeview Building, 7/1 floor, district 2, registered with the Trade Registry Bucharest under no. J40/1784/1995, Sole Code of Registration 7108710, having share capital RON 214,160, being registered as processor of personal data under the number 20877 (the “Company”) and by <<Societatea Civila de Avocati “D&B David si Baias”>> - Law Firm, having its  in Bucharest, Sector 2, Barbu Vacarescu street no. 301-311, Lakeview Building, 9/1 floor, fiscal registration code RO 14737844, being registered as processor of personal data under the number 20920 (the “Law Firm”) for the following purposes:

1.       execution of contracts binding me / my employer and the Company and/or the Law Firm and provision by the Company and/or the Law Firm of their services, including services ordered by third parties and/or for their benefit;

2.       provision by the Company and/or the Law Firm or by a third party provider, for my benefit, of services, based on a contract;

3.       marketing and promotions regarding goods and services offered by the Company and/or the Law Firm;

4.       connected with independence, risk management and quality reviews;

5.       realisation of corporate or other regulatory requirements of the Company and/or the Law Firm.

I also give my consent for the transfer of my personal data between entities which belong to the PricewaterhouseCoopers network in Romania, namely:

1.       PricewaterhouseCoopers Audit S.R.L.;

2.       PricewaterhouseCoopers Servicii S.R.L.;

3.       PricewaterhouseCoopers Business Recovery Services S.P.R.L.;

4.       PricewaterhouseCoopers Management Consultants S.R.L.;

5.       PricewaterhouseCoopers Tax Advisors&Accountants S.R.L.;

6.       D&B – David si Baias – Societate Civila Profesionala de Avocati (which is a correspondent law firm to the PricewaterhouseCoopers Network)

as well as to other entities associated with the Company and/or the Law Firm around the world located in countries whose legislation provide the guarantee of protection of personal data on their territories at least as such as standing on the territory of Romania for the purposes of realisation of corporate requirements, including for marketing purposes.

The consent for the processing expressed above includes the following range and categories of personal data: full name, home address, personal and/or business email address, personal numeric code, date and place of birth, citizenship, personal and/or business telephone and fax numbers (including mobile phone), gender, signature, marital status, data of/from the identity card/passport (or similar document), place of work, date of employment, company address, profession/job title and position within the company, professional relationship to other individuals, professional qualifications (diplomas, studies etc.), image.

I hereby represent that I have been informed about my rights* regarding my personal data processed by the Company and the Law Firm, pursuant to the provisions of Law no. 677/2011, as subsequently amended and completed, notably the right to:

1.     access my personal data;

2.     intervention upon my personal data (rectification, updating, blocking, deletion of data processed in breach of the law, especially as regards the incorrect or incomplete data);

3.     make a justified demand in writing for the opposition to / the blocking of the processing of my data due to particular situation;

4.     object to the processing of my personal data if the controller intends to process the data for direct marketing purposes or to object to the transfer of the data to another controller;

5.     the right of not being subjected to an individual decision which produces legal effects in his/her respect and which is adopted exclusively based on a processing of personal data, destined to evaluate certain aspects of his/her personality, such as professional competence, credibility, behaviour, and other similar.

The requested information is not compulsory. However, the consequences of the refusal to provide such information are: possible inability to render services by the Company/Law Firm for the person in question and/or impossibility to conclude a contract with such person for the provision of services, limitation of access to the website (www.taxonline.ro).

DECLARATION OF CONSENT FOR THE RECEIVING OF COMMERCIAL INFORMATION IN ELECTRONIC WAY

Pursuant to Article 12 of Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, Published in the Official Journal of Romania, Part I, no. 1101 of November 25th, 2004, as subsequently amended and completed, I, the undersigned, hereby express my consent to receive from S.C. PricewaterhouseCoopers Tax Advisors and Accountants S.R.L., Romanian legal entity with the registered address in Bucharest Town, 301-311 Barbu Vacarescu St., Lakeview Building, 7/1 floor, district 2, registered with the Trade Registry Bucharest under no. J40/1784/1995, Sole Code of Registration 7108710, having share capital RON 214,160, being registered as processor of personal data under the number 20877 and/or from <<Societatea Civila de Avocati “D&B David si Baias”>> - Law Firm, having its  in Bucharest, Sector 2, Barbu Vacarescu street no. 301-311, Lakeview Building, 9/1 floor, fiscal registration code RO 14737844, being registered as processor of personal data under the number 20920, commercial information in electronic way.

* any person has the right to oppose, for legitimate reasons, to the processing of its personal data. Such opposition right may be excluded for certain processing provided by the law (e.g: processing conducted by the fiscal and financial services, police, justice, social security); moreover, any person has the right to oppose freely, at any moment and without justification, to the processing of its personal data for direct marketing purposes.
